Welcome to the Terms and Conditions of Service (“Terms”) of CreActive Digital LLC (“we,” “our,” or “the Company”), owner and operator of the website www.wp-curve.com (“Site”). By using our white-label hosting services (“Services”), you agree to these Terms. Please read them carefully.
1. Acceptance of Terms
By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Description of Services
CreActive Digital LLC provides managed white-label hosting services utilizing third-party infrastructure, including WPMU DEV’s services and plugins. We deliver an optimized hosting experience for WordPress, including technical support and advanced tools for managing websites.
3. Hosting
By using our hosting services, you agree to the following:
- You authorize us to access your website and database to provide hosting services and/or backup content.
- To address security vulnerabilities, we may, upon prior notice, apply updates to your site or access it to remove malicious code.
- We may analyze your data and content to compile aggregated and anonymized statistics for internal use to optimize service performance and security.
- If you lose access to your account or cancel your membership, you will not be able to access hosting or backup data. We may not recover backups or data beyond fourteen (14) days after the account is deactivated.
- You grant us a worldwide, royalty-free, and non-exclusive license to copy and store your data and content only to the extent necessary to operate the service. Your data and content remain your property.
Uptime Objectives
- Our goal is to ensure 100% uptime for hosted sites (24/7/365). However, if this goal is not achieved, the following Service Level Agreement (SLA) applies:
- We guarantee 99.9% uptime.
- We do not impose strict limits on traffic, visits, or bandwidth. However, in cases of traffic spikes (human or bot), your site may experience slowdowns or downtime. In such cases, we will notify you to upgrade your hosting plan, and the SLA will not apply.
- If the SLA is not met during a calendar month, you are entitled to an SLA Credit. You must contact support to request the credit within 30 days after the end of the affected month. Credits will be calculated at 5% of your monthly hosting charges for each full hour of downtime beyond the SLA, up to 100% of your monthly charges. Downtime is determined by our monitoring tools.
- The SLA covers human errors by our team or third-party providers involved in hosting services.
- The SLA does not cover downtime caused by third-party code, user errors, or events beyond our control, such as natural disasters.
Inactive Site Archiving
- Free hosted sites or sites paid with promotional credits may be archived after 21 days of inactivity. A site is considered “active” if:
- The site settings are accessed at least once in the Hub within the past 21 days.
- A custom domain has been added and validated.
- We will send a warning email one week before archiving and another when the site is archived. Archived sites can be restored within 30 days.
4. Snapshot and Backup Services
If you use our Snapshot Pro or Hosting backup services, the following terms apply:
- You grant us access to your website, database, and any virtual or physical servers to perform data backups or restorations.
- We may scan your data and content to compile aggregated/anonymized statistics for internal use to optimize the performance and security of the service.
- If you lose access to your account or cancel your membership, you will no longer have access to your backup data. We may not be able to recover backups or data more than fourteen (14) days after the account is deactivated.
- You grant us a worldwide, royalty-free, and non-exclusive license to copy and store your data and content only to the extent necessary to operate the service. Your data and content remain your property.
Backup Storage and Retention
- All accounts include free storage space for Snapshot backups shared across all Hub-connected sites. Backup retention is up to 50 days, depending on your membership plan. Additional storage can be purchased if required.
- Hosting plans include nightly backups at no additional storage cost. These backups are retained for up to 30 days.
- Hourly backup services are available for individual sites at an additional cost.
5. Payments and Subscriptions
- Many of our Services require an active paid subscription (“Paid Services”), including WPMU DEV Memberships, Hosting, Managed Backups, and CDN. By using a Paid Service, you agree to pay the specified fees, which will be charged in regular intervals (e.g., monthly or annually) on a pre-pay basis until you cancel.
- Paid Services are automatically renewed to ensure uninterrupted service. If you do not cancel before the end of the applicable subscription period, the subscription will automatically renew, and you authorize us to invoice you or use your payment method on file to collect the subscription fee and any taxes. Renewals are for the same interval as the original subscription.
- Cancellations: If you cancel your subscription, your membership will remain active until the end of the current billing cycle.
- Failed Payments: If payment fails or Paid Services are not paid on time, access to the Paid Services may be canceled or revoked.
- Fee Changes: We reserve the right to change fees and will notify you of any changes. If you do not agree, you can cancel the service.
Refund Policy
- Refunds are issued at the discretion of our support team. No refunds are granted for subscription payments after 30 days unless due to billing errors on our part.
- Declined charges via your bank or credit card company may result in revoked access without refund.
- Domain Registration, Renewal, Transfer, and Redemption fees are non-refundable under any circumstances.
- Refunds are issued only once per customer/entity and will not be issued for violations of these Terms.
6. Support
- Support is provided in English only via Live Chat and Forums.
- Our team is available 24/7/365 with average Live Chat wait times under 10 minutes. Issue resolution depends on complexity and queue.
- Support is only available for sites connected to the Hub and requires the latest version of WordPress and related plugins.
- For site issues, a backup should be created before requesting support. We are not responsible for lost content or downtime during troubleshooting.
7. Security
- You are responsible for securing your account and must notify us of any unauthorized use or breaches.
8. Legal Notices
- Our Services are provided “as is,” with no warranties of any kind. Access and use of our Services is only for individuals aged 13 or older (16 in the EU).
- We are not liable for any interruptions, errors, or losses incurred from using our Services.
9. Domains
- Domain registration services are governed by ICANN and relevant Registry policies. Fees for domain registration, renewal, and transfer are non-refundable. You are responsible for maintaining accurate contact details for domain ownership.
